Just Cause for Eviction Expansion
On Tuesday, July 5th, Oakland City Council will decide whether or not to put a measure on the November ballot that would extend just cause eviction protections to all buildings in Oakland (including RV facilities). If passed, it would also:
- Amend the Just Cause Ordinance so that a landlord could not evict a tenant for refusing to sign a new lease, effectively allowing all leases to go month-to-month at the end of their initial term.
- Explicitly require landlords who abuse their right to an owner move-in eviction to permit the tenant to move back into the unit and to pay for the tenant’s moving expenses.
- Require landlords who require tenants to move-out for the purpose of bringing their unit up to code to provide a list of the code violations and repairs that were done (to help prevent landlords from abusing this good cause for eviction in order to make unnecessary or inadequate repairs and then jacking up the rent).
- Prohibit no-fault evictions of educators and families with school-aged children during the school year.
